Activison Gets a Slap on the Wrist in Suit Over Wii Guitar Hero's Mono Sound
April 8, 2008 | 2:30 PM PST

by: Nathan Grayson

When you were a wee child, we're sure you committed some fairly despicable acts -- playground scuffles, swearing, and the ubiquitous theft of cookies all prompted swift punishment from the proper authorities. And in the case of those cookies, it was quite appropriate on your parents' part to take cookies out of your diet altogether for some time. Well, Actvision and their Guitar Hero franchise were facing a similar situation, but you'd be ill-advised to dip millions of dollars in a cold glass of milk.

Last December, Samuel Livingston, in the United States District Court for the Central District of California, filed suit against Actvision for alleging that the Wii version of Guitar Hero III both rocked and rolled in Dolby Pro Logic II, when, in fact, it only strummed lightly in mono. His suit demanded, most prominently, that Activision be stripped of all profits stemming from the Wii version of Guitar Hero III -- quite a step up from losing a few soft, delicious cookies.

Fortunately for Activison, it seems they're off the hook. The suit was settled out of court, and Activison must merely extend their Guitar Hero III replacement program until August 31. So breathe in deep, Activision; through the fire and the flames, you carried on.
